TXAdvance Scan Exchange or the TASE Service (including the TXAdvance Android/iOS apps, the Compasseur website and the associated OpenStreetMap) that Compasseur provides to users is subject to the following Terms of Use (« TOU »). Compasseur reserves the right to update the TOU at any time. The most up-to-date version of the TOU will always be available on Compasseur.com. Violating these TOU may result in the suspension or deletion of a User’s uploaded data to the TASE.
By using Compasseur TASE service, user agrees to comply with all of the terms and conditions hereof.
Compasseur shall have the right at any time to change or discontinue any aspect or feature of the TASE service, including, but not limited to, content, hours of availability, and equipment needed for access or use.
Compasseur reserves the right at any time to change or modify the terms and conditions that apply to User’s use of the TASE service, or any part thereof including the software platform featured on the site and on the Android/iOS apps, or to impose new conditions on User, including but not limited to usage or service fees. Such changes, modifications, additions or deletions shall be effective immediately upon issuance of reasonable notice. Reasonable notice may take the form of postings on Compasseur.com, email notifications, conventional mailings, in-software prompts, Facebook post or other commercially viable means. Any use of Compasseur.com and the TASE service by User after such notice shall be deemed to constitute acceptance by User of such changes, modifications or additions.
Through Compasseur.com, TXAdvance.com or the Android/iOS apps, Compasseur provides User with access to .txa files uploaded by any user around the world and the possibility to upload .txa files to the TASE. The .txa files contain RF spectrum, geolocalisation, dates and hours…information The TASE Service, including any updates, enhancements, new features…, are subject to these TOU.
User shall use the TASE service for lawful purposes only. User shall not post or transmit through Compasseur.com, the TASE service and/or the TXAdvance Android/iOS apps any material which violates or infringes in any way upon the rights of others, which is unlawful, threatening, abusive, defamatory, invasive of privacy or publicity rights, vulgar, obscene, profane or otherwise objectionable, which encourages conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate any law, or which, without Compasseur’ express prior approval, contains advertising or any solicitation with respect to products or services. Any conduct by a User that in Compasseur’ discretion restricts or inhibits any other User from using or enjoying the TASE service will not be permitted. User shall not use the TASE service to advertise or perform any commercial solicitation, including, but not limited to, the solicitation of users to become subscribers of other information services that compete with Compasseur Services or the TXAdvance Android/iOS apps.
Compasseur and the TASE Services contain copyrighted and other proprietary information, including, but not limited to, text, software, photos, video, graphics, music and sound; the entire contents of the TASE service is copyrighted as a collective work under international intellectual property laws. Compasseur owns a copyright in the selection, coordination, arrangement and enhancement of such content, as well as in the content original to it. User may not modify, publish, transmit, participate in the transfer orsale, create derivative works, or in any way exploit, any of the content, in whole or in part. User may download copyrighted material for User’s personal use only. Except as otherwise expressly permitted under copyright law, no copying, redistribution, reverse engineering, retransmission, publication or commercial exploitation of downloaded material will be permitted without the express permission of Compasseur. In the event of any permitted copying, redistribution or publication of copyrighted material, no changes in or deletion of author attribution, trademark legend or copyright notice shall be made. User acknowledges that it does not acquire any ownership rights by downloading copyrighted material.
User shall not upload, post or otherwise make available on the TASE service any material that is protected by copyright, trademark or other proprietary right without the express permission of the owner of the copyright, trademark or other proprietary right. The burden of determining respective intellectual property ownership in these situations rests with User. User shall be solely liable for any damage resulting from any infringement of copyrights, proprietary rights, or any other harm resulting from such a submission. By submitting Radio Frequency scans to the TASE service, User automatically warrants that the owner of such material has granted Compasseur the royalty-free, perpetual, irrevocable, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate and distribute such material (in whole or in part) worldwide and/or to incorporate it in other works in any form, media or technology now known or hereafter developed for the full term of any copyright that may exist in such material. User also permits any other User to download, access, view, import, use, store or reproduce the material for that User’s personal use. User hereby grants Compasseur the right to edit, copy, publish, use, and distribute any material made available on the TASE service by User in any manner. Data use may include, but is not limited to, general improvements to the TASE service, TXAdvance Android/iOS apps or other products of Compasseur, development of new features, workflow improvements, and formula creations for the benefit of the TASE service or Users.
User agrees that when using the TASE service, User will not:
-Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others.
-Publish, post, upload, distribute or disseminate any inappropriate, profane, defamatory, obscene, indecent or unlawful topic, name, material or information.
-Upload, or otherwise make available, files that contain images, photographs, software or other material protected by intellectual property laws, including, by way of example, and not as limitation, copyright or trademark laws (or by rights of privacy or publicity) unless User owns or controls the rights or have received all necessary consent to do the same.
-Use any material or information, including images or photographs, which are made available through the TASE service in any manner that infringes any copyright, trademark, patent, trade secret, or other proprietary right of any party.
-Upload files that contain viruses, Trojan horses, worms, time bombs, cancelbots, corrupted files, or any other similar software or programs that may damage the operation of another’s computer or property of another.
-Upload files that were not generated by the TXAdvance Android/iOS apps.
-Upload Radio Frequency spectrum informations that were illegally collected.
-Falsify or delete any copyright management information, such as author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that is uploaded.
-Harvest or otherwise collect information about others, including e-mail addresses.
-Violate any applicable laws or regulations.
-Create a false identity for the purpose of misleading others, including Compasseur.
-Use outputs from the TASE service to build competitive products or in a manner inconsistent with Compasseur Branding Guidelines.
Compasseur reserves the right to review materials posted to the TASE service and to remove or modify any materials and content in its sole discretion. Acting in a manner proscribed above is considered a material breach of these TOU and Compasseur reserves the right to terminate User’s access to any or all of the TASE service in that instance without notice. Compasseur reserves the right at all times to disclose any information as it deems necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in Compasseur’s sole discretion. Materials uploaded to the TASE service may be subject to posted limitations on usage, reproduction and/or dissemination; User is responsible for adhering to such limitations if User downloads the materials.
Always use caution when giving out any personally identifiable information in the TASE service. Compasseur does not control or endorse the content, messages or information found in the TASE service and, therefore, Compasseur specifically disclaims any liability with regard to the TASE service and any actions resulting from User’s participation in the TASE service.
The TASE service require all users to provide a name or username and a valid email address. User is entirely responsible for any and all activities that occur under User’s email address. User agrees to notify Compasseur immediately of any unauthorized use of User’s personnal informations or any other breach of security. Compasseur will not be liable for any loss that User may incur as a result of someone else using User’s informations, either with or without User’s knowledge. User may not use anyone else’s personnal informations at any time.
User understands and acknowledges that Compasseur.com, the TXAdvance Android/iOS, the TASE service and the products featured therein for download, upload, or use are intended for use by audio and radio frequency professional. User attests to User’s understanding that User must exercise independent judgment when evaluating and verifying any and all information contained in any Compasseur Service including but not limited to the TASE service.
For User’s convenience, Compasseur and its users may make available tools and utilities for download and/or use. Compasseur does not make any assurances with regard to the accuracy of the results, outputs and downloaded .txa files that derives from such use of any such tools and utilities.
Compasseur does not claim ownership of the material that Users provide and/or upload to the TASE service or other Users while using Compasseur’s web services and/or its TXAdvance Android/iOS apps.
By posting, uploading, inputting, providing, or submitting data in the TASE service and sharing it, User grants Compasseur, its affiliated companies and their collective sub-licensees permission to use User’s Submission. These rights include without limitation the license rights to copy, distribute, transmit, remove, publicly display, publicly perform, reproduce, edit, translate and reformat User’s Submission; to publish User’s name in connection with User’s upload; to design improvements to the software or other products of Compasseur.
No compensation will be paid with respect to the use of User’s Submission, as provided herein. Compasseur is under no obligation to post or use any Submission that User may provide and Compasseur may remove any Submission at any time in its sole discretion. By Posting a Submission User warrants and represents to own or otherwise control all of the rights to User’s Submission as described in these Terms of Use including, without limitation, all the rights necessary for User to scan the RF spectrum at location, provide, post, upload, input or submit the scan. This permission is tantamount to a non-exclusive, world-wide, royalty-free license to copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate and reformat User’s uploaded.
User expressly agrees that Compasseur can not certify that the content downloaded from the TASE service is reliable, accurate and up-to-date.
The TASE service is provided on an « as is » basis without warranties of any kind, either express or imlied, including but not limited to, warranties of title or implied warranties of fitness for a particular purpose.
Compasseur shall not be liable for any errors, inaccuracies, omissions or other defects in the informations and scans available on the TASE service.
Compasseur shall have the right, but not the obligation, to monitor the content of the TASE service to determine compliance with this agreement, any operating rules established by Compasseur and any law, regulation or authorized government request. Compasseur shall have the right in its sole discretion to edit, refuse to post, or remove any material submitted to or posted on the TASE service if and when such features are activated. Without limiting the foregoing, Compasseur shall have the right to remove any material that Compasseur, in its sole discretion, finds to be in violation of the provisions of this agreement or is otherwise objectionable.
